Adjustment of Status

Adjustment of status is a process through which an eligible person in the United States applies for lawful permanent residence, generally using Form I-485. Eligibility depends on the immigration category, visa availability, admission or parole requirements where applicable, admissibility and any statutory bars or exceptions.

An approved petition or a pending asylum application does not, by itself, establish eligibility to adjust status. Prior entries, periods without status, unauthorized employment, immigration proceedings, criminal history and prior immigration filings may affect the analysis.

Some applicants can file a petition and adjustment application together; others must wait. Employment authorization and permission to travel are separate issues. Leaving the United States without appropriate authorization may affect the application or create other immigration consequences.

We review the underlying category, immigration history and supporting evidence before recommending a filing strategy.
